General Terms and Conditions
With philamall.com Philamall provides an internet sales platform (hereinafter called “platform”) where users can acquire stamps among others after registration. Philamall is not becoming a contracting partner thereby, yet only provides the respective platform as a service provider.
Every fully legally competent and natural person being 18 years old at least as well as juristic persons can register as user. Properly registration with truthful specifications of the postulated information is the precondition therefore. Users are obliged to independently and immediately inform Philamall of any changes in the communicated information
There is no claim on the use of the platform. The user can become excluded from using the platform when giving false information while registering or not immediately communicating changes.
The user him- / herself is responsible for the safety of his password. Passing on to third parties is not permitted.
There is only insofar a contractual relationship between the user and Philamall as Philamall provides the user with a platform for the sale of goods on the foundation of these terms of use. Contracts of sale between Philamall and the particular user of the platform will not materialise. Such contracts of sale can only materialise between the user and the particular shop operator. Neither Philamall is a representative of the particular shop operator, nor are the particular shop operators representatives of Philamall
In the case of an offence against the terms of use, Philamall is authorised to exclude the user from the platform or take other appropriate action.
Subject to the following paragraphs two and / or three, both claims for damages of the user, no matter on what legal ground, as well as claims for the replacement of futile expenditure depending on the size are (a) restricted regarding delivered causal damaged goods to the amount of the appointed prize concerning this matter and b) excluded for the rest.
The corporate veil according to paragraph one does not apply in case the cause of damage is based on a coarse negligent or deliberate breach of duty or at least on a negligent breach of basic contractual obligations (cardinal obligations). In case of a negligent breach of basic contractual obligations the extent of the liability is limited to the typical foreseeable damage.
Moreover the corporate veil according to paragraph one does not apply for damage done by the breach of life, body or health, for liability according to the Product Liability Act or as far as Philamall has fraudulently concealed a fault or exceptionally taken over a guarantee.
Philmall does not take over any warranty that the platform is permanently available. Philamall also does not take over any warranty for the correctness of the transacted information regarding the objects of purchase done by the shop operators.
The buyer can buy any item offered by a shop operator. Philamall notifies the buyer about the received ordering.
Goods offered in the shops of the platform can be paid in different currencies. The currency rates forming the basis of the currency translation will be updated several times a day. Philmall does not take over any warranty for the updated correctness of the currency rates
These general terms and conditions apply to German law.
